What triggers these penalties
Tier 1 — Prohibited
Up to €35M or 7%Using banned AI practices: social scoring, manipulative systems, real-time remote biometric identification in public spaces
Article 5, Article 99(3)
Tier 2 — High-risk
Up to €15M or 3%Non-compliance with high-risk obligations: risk management, data governance, documentation, human oversight, transparency, accuracy
Articles 8–15, 26, 99(4)
Tier 3 — Misleading info
Up to €7.5M or 1%Supplying incorrect or misleading information to authorities, failing to cooperate with market surveillance
Article 99(4)(e)
These are maximum penalties. Actual fines will be determined by national market surveillance authorities, taking into account the nature, gravity, and duration of the violation, plus any mitigating factors (Article 99(7)).
The Digital Omnibus proposal does not change the penalty structure. Even if high-risk compliance deadlines are extended, the penalty tiers remain the same.
